Terms and Conditions of Participation
1. Scope of Application
The following terms and conditions of participation apply to all events organized by The Third Time UG, in particular the event Frankfurter Runden in Frankfurt am Main on 29 May 2022 (hereinafter individually referred to as an “Event” or collectively as “Events”).
The organizer of the respective Events is The Third Time UG (limited liability), Kapellenstraße 14, 76698 Ubstadt-Weiher (hereinafter referred to as “we”, “us” or the “Organizer”).
The terms and conditions of participation in the version valid at the time of registration form an integral part of the contract between The Third Time UG and the participants.
2. Registration, Participation Fees, Services
2.1 The Organizer’s service consists of conducting the respective Event for which the participant has registered.
2.2 Registration for the respective Event is possible up to the registration deadline stated in the event announcement via online registration on our website www.frankfurter-runden.de
, provided that the maximum permitted number of participants has not yet been reached. The contract between the participant and the Organizer is concluded upon dispatch of the registration confirmation, which is sent by email immediately after registration.
2.3 If the maximum permitted number of participants is reached before the registration deadline stated in the announcement, registration will be closed early. Further registrations for this Event will then no longer be possible.
2.4 Prior to the respective Event, all relevant information regarding the Event will be sent by email to the email address provided by the participant during registration.
2.5 In the case of group registration, the registering person guarantees that he/she is authorized to register and enter the personal data of all group members and to submit all declarations on their behalf. The registering person shall inform all group members of the terms and conditions of participation and the data protection provisions.
2.6 Registrations for minors or persons with limited legal capacity for Events approved for them may only be made by their legal representatives. A corresponding liability waiver and consent form signed by a legal representative must be submitted to the Organizer in advance by post or email. Any collection of the race number on site must also be carried out in the presence of a legal representative.
2.7 The participation fee stated in the registration applies. Payment of the participation fee and any fees for selected additional services (medal engraving, photo services, or participant shirt) may be made by SEPA direct debit or credit card.
2.8 If the participant declares that he/she does not wish to adhere to the contract for participation in an Event (e.g. by notice of termination or withdrawal), cancels participation, or fails to attend the Event without notice (no-show), this shall be deemed a final waiver of the right to start or participate in the Event, irrespective of whether the participant is entitled to do so.
There is no entitlement to a refund of the participation fee. This also applies in the event of exclusion of the participant pursuant to section 4.1 of these terms and conditions or in the event of disqualification.
Any booked additional services may be transferred to a subsequent or replacement Event of the Ring Running Series or refunded.
2.9 Transfer of the registration to third parties is not permitted. Likewise, collection of the race number on site by third parties is not permitted, except upon presentation of a written authorization.
2.10 In the event that the Event is canceled for reasons beyond the Organizer’s control (e.g. severe weather, terrorism, epidemics, war, natural disasters, official orders, or the COVID-19 pandemic), it is possible to transfer the starting place to a subsequent Event within the Frankfurter Runden without an additional processing fee, provided the maximum permitted number of participants has not yet been reached. Any booked additional services may also be transferred to a subsequent Event or refunded.
If a transfer to a subsequent Event is not possible, the participation fee and the fee for any booked additional services will be refunded. However, amounts paid for specially designated Events to cover the costs of organizing and preparing the Event in light of the unforeseeable consequences of the COVID-19 pandemic will not be refunded, as without these contributions the sporting event would not have been feasible for us.
2.11 In the event of premature termination of the Event due to force majeure or due to official orders beyond the Organizer’s control (e.g. measures to combat the COVID-19 pandemic), or changes in the execution of the Event required for safety reasons, The Third Time UG shall not be liable for damages toward participants. In such cases, the Organizer is entitled to withdraw starting rights, exclude individual or all participants from the Event, and/or withdraw from the contract. No refund of the participation fee will be granted in these cases.
2.12 The Organizer reserves the right to make changes to the execution of the Event, for example due to official orders beyond its control. Otherwise, section 2.11 applies accordingly.
If the Organizer is entitled or obliged due to force majeure, official orders beyond its control, or for safety reasons to reduce the number of participants, a draw will be held for the officially prescribed maximum number of participants. Affected participants will be informed immediately about any (partial) cancellation and the resulting solutions and measures.
3. Eligibility to Participate, Competition Rules, Health Requirements
3.1 Any person who fulfills the participation requirements (e.g. minimum age) for the respective Event, has successfully registered for the Event at www.frankfurter-runden.de
, and is not subject to a starting ban at the time of the Event is eligible to participate.
3.2 The participant acknowledges the national and international competition rules (IWR) of the IAAF or DLV applicable to the Event, in particular the anti-doping regulations.
3.3 The participant must personally start in the Event. Any transfer of the race number without the Organizer’s knowledge, or participation by a third person in the name of the registered participant, will result in exclusion from the race. Further sanctions in accordance with the rules under section 3.2 remain reserved.
3.4 The participant assures that he/she will only start on the day of the Event if he/she is healthy and sufficiently trained to complete the course within the prescribed maximum time using his/her own strength. If there is a potential risk of health damage, the participant will be immediately removed from the race and excluded from the Event. In the event of signs of discomfort and/or weakness, the participant must immediately abandon the race.
Participation is prohibited in the case of a known chronic illness that requires special care, including medical care, during the Event. The Organizer does not provide special support during the race. Medical care for participants with chronic illnesses during the race is only permitted after prior accreditation by the Organizer.
If there is a justified suspicion of a COVID-19 infection on the day of the respective Event, participation will also be excluded.
3.5 Each participant is assigned a personal, non-transferable race number. This will be sent in advance by post to the address provided by the participant. In the event of on-site collection of the race number at the event venue, the participant must present the registration confirmation and a valid photo ID. Minors and persons with limited legal capacity must collect their race number in the presence of a legal representative or present a consent and liability waiver signed by a legal representative.
3.6 The race number issued to the participant must be worn visibly on the chest in accordance with international competition rules and must not be altered in any way. In particular, any advertising print must not be made invisible or illegible. The race number entitles the holder to enter the event venue and participate in the Event. A transponder integrated into the race number is used for check-in and check-out as well as for timekeeping. Without the race number, no timekeeping or classification will take place. The race number must be worn from entry to exit of the event venue.
3.7 Leaving or shortening the course is prohibited under international competition rules. It is also prohibited to be accompanied by non-participants or persons using aids, or to use any type of aids oneself. In addition, international anti-doping regulations apply to all participants. Violations will be sanctioned.
3.8 Instructions issued by the Organizer and its agents (e.g. security staff, medical personnel, referees, etc.) must be followed at all times. This applies in particular to compliance with COVID-19 hygiene measures. All relevant information regarding the respective Event is available online on our website and is continuously updated. Participants are advised to review this information before the race.
4. Results, Violations, Starting Ban and Disqualification
4.1 Any participant who violates international competition rules or these terms and conditions, or fails to follow the instructions of the Organizer and/or its staff, thereby endangering the proper conduct of the Event, the safety and/or health of participants or staff, will be excluded from the Event and/or disqualified. Exclusion and/or disqualification may occur, among other reasons, in the following cases:

grossly unsportsmanlike or undisciplined behavior

violation of applicable national and international competition and association rules
-
violation of international anti-doping regulations
-
acceptance of unauthorized external assistance
-
alteration (e.g. folding, cutting, or rendering illegible) or covering of the race number
-
unauthorized transfer of the personal race number or unauthorized acceptance and use of a race number not personally assigned
-
shortening of the course
-
failure to cross control mats on the course
-
participation without a personally assigned race number
-
failure to comply with instructions of event staff
4.2 The Organizer reserves the right to impose a starting ban on the participant for future Events organized by the Organizer in the event of violations. The participant will be informed in writing (by post and/or email).
4.3 The results lists will be published on our website after the respective Event. Objections to the results lists are only possible within 24 hours after the Event.
5. Photo and Video Recordings
Photo and video recordings will be made during the Events for editorial and commercial purposes, which may show participants. These may be published in traditional media (television, radio, newspapers, etc.) as well as online (internet, social media, etc.). The Organizer will also document the Events in image and sound and may publish excerpts. Due to the size of the Event, it is not possible to exclude individual participants from the recordings.
By registering for the Event, the participant grants the Organizer and/or third parties commissioned by it a simple, irrevocable, time- and location-unlimited and transferable right of use to the photos, videos, and interviews produced in connection with the Event. Participants waive their right to be named. In the case of minors or persons with limited legal capacity, the consent of the respective legal representative is required.
6. Liability and Force Majeure
6.1 The Organizer is liable for intent and gross negligence. In cases of slight negligence, the Organizer is liable for damages resulting from injury to life, body, or health.
6.2 In all other cases of slight negligence, the Organizer is only liable for breach of an essential contractual obligation, the fulfillment of which is necessary for the proper performance of the contract and on whose compliance participants regularly rely (cardinal obligation). Liability for slight negligence is limited to the foreseeable damages typical at the time of contract conclusion. This limitation of liability also applies in favor of the agents and employees of The Third Time UG.
7. Right of Withdrawal
Pursuant to Section 312g No. 9 of the German Civil Code (BGB), participants have no right of withdrawal.
8. Data Protection
8.1 The personal data transmitted by the participant during registration for the respective Event will be stored by the Organizer for the purpose of conducting the Event. This also includes publication of the Event results, entry on personalized certificates and medals, as well as documentation and payment processing of any medical care provided on the course and in the finish area.
Data processing is carried out at the request of participants and is necessary pursuant to Art. 6(1) sentence 1 lit. b GDPR for the performance of the participation contract and pre-contractual measures.
Personal data collected by us in the course of contract performance will be stored until the expiration of statutory limitation periods after contract fulfillment, unless statutory retention obligations exist or participants have consented to storage beyond this period pursuant to Art. 6(1) sentence 1 lit. a GDPR.
8.2 In addition, participants’ surname, first name, year of birth, nationality, gender, club (if applicable), race number, and result (placement and times) will be processed and published in participant and results lists in relevant event-related media (online and print), and may be passed on to third parties for publication (e.g. newspapers, results services, timing services, photo services, etc.) and stored for the creation of a results database.
This data processing and transfer is based on our legitimate interests pursuant to Art. 6(1) sentence 1 lit. f GDPR. Personal contact or address data will not be passed on, or only after prior consent by the participant (in writing or via opt-in on the website or during registration).
8.3 The publication of image and audio recordings pursuant to section 5 of these terms and conditions is based on Art. 6(1) sentence 1 lit. f GDPR.
9. Final Provisions
The law of the Federal Republic of Germany shall apply.
